WAIVER

SWIM LESSON WAIVER & RELEASE OF LIABILITY

Waivers are required for all participants.

ASSUMPTION OF RISK AND WAIVER OF LIABILITY (“Release”)

For the purposes of this agreement, “Activity” refers to all private, semi-private, and group swim lessons, water training, and any related aquatic instruction provided by SJ Swim Master in any pool facility or location.

By signing this waiver, I acknowledge and agree to the following:

ASSUMPTION OF RISK

I understand that participation in swim lessons and water-based activities involves inherent risks. These risks may include, but are not limited to: minor injuries (such as bruises, strains, or sprains), more serious injuries (such as fractures, head, neck, or back injuries), and in rare cases, catastrophic injury or death, as well as damage or loss of personal property.
I understand that there may be additional known and unknown risks associated with aquatic activities.
I voluntarily choose to participate (or allow my child to participate) in these activities and fully accept and assume all risks involved.

WAIVER OF LIABILITY

I, on my own behalf and/or on behalf of my child, heirs, and personal representatives, hereby release, waive, discharge, and hold harmless SJ Swim Master, its instructors, employees, contractors, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of participation in swim lessons or related activities, whether caused by negligence or otherwise, to the fullest extent permitted by law.

GENERAL TERMS

I confirm that I am 18 years of age or older, or if signing for a minor, I am the parent or legal guardian of the participant.
I understand that this waiver is governed by the laws of the State of New York and is intended to be as broad and inclusive as legally permitted. If any portion is found invalid, the remaining provisions will continue in full force and effect.

ACKNOWLEDGMENT

By signing below, I confirm that I have read, understood, and voluntarily agree to all terms of this waiver. I understand that I am giving up certain legal rights, including the right to sue.
