Program Terms & Conditions
1. Overview
SJ Swim Master provides structured swim education programs delivered inside residential building pools throughout New York City.
By enrolling in a SJ Swim Master program, you agree to the terms outlined below, which govern enrollment, scheduling, attendance, payment, make-up tokens, and program operations.
SJ Swim Master operates as a seat-based enrollment system, with Semester Enrollment as the primary offering and Monthly Enrollment available based on capacity.
2. Definition of an Instructional Seat
An Instructional Seat refers to a reserved recurring instructional time assigned to one swimmer within a building-based route for the duration of the selected enrollment period.
Each Instructional Seat includes:

Recurring instructional time

Assignment within a structured building route

Curriculum-based progression
-
Instructor-led instruction, subject to operational availability
Instructional Seats are limited and assigned based on route capacity, pool availability, scheduling, and program capacity.
An Instructional Seat is assigned to the enrolled swimmer and cannot be transferred to another swimmer without approval from SJ Swim Master.
3. Program Structure
SJ Swim Master offers two enrollment options:
Semester Enrollment — Primary Offering
Semester Enrollment is designed to provide consistent instruction and long-term skill development.
Semester Enrollment includes:

Reserved weekly Instructional Seat
-
Priority placement within building routes
-
Structured semester-based learning cycle
-
Limited-capacity enrollment
-
4 make-up tokens per Instructional Seat, per semester
Semester Enrollment remains active for the full semester and cannot be paused or partially suspended after the semester begins.
Monthly Enrollment — Secondary Offering
Monthly Enrollment is available only when instructional capacity remains after Semester Enrollment has been accommodated.
Monthly Enrollment:

Is billed monthly
-
Provides access to available instructional time slots

Follows the same curriculum standards
-
Does not receive priority scheduling
-
Includes 1 make-up token per Instructional Seat, per month
-
May be transitioned into Semester Enrollment in future enrollment cycles, subject to availability
Monthly Enrollment availability may change based on enrollment demand, route capacity, and operational needs.
4. Scheduling & Route Assignment
Instructional times are assigned through SJ Swim Master's Route-Based Scheduling System, which considers:

Building location
-
Instructor routing efficiency
-
Pool availability
-
Enrollment capacity
-
Operational logistics
Scheduling preferences may be considered whenever reasonably possible; however, requested days and times cannot be guaranteed.
SJ Swim Master may adjust instructional times, routes, or instructor assignments when reasonably necessary to maintain efficient operations.
5. Attendance & Make-Up Token Policy
Tuition reserves the swimmer's Instructional Seat within a limited-capacity program.
Clients are responsible for attending their scheduled instructional sessions.
Missed sessions do not automatically qualify for refunds, credits, prorated tuition, or additional sessions except as provided through the applicable Make-Up Token Policy.
Make-Up Tokens
Each Instructional Seat receives make-up tokens based on the selected enrollment type:

Semester Enrollment: 4 make-up tokens per semester

Monthly Enrollment: 1 make-up token per month
Make-up tokens may be used for missed scheduled instructional sessions without providing a reason or explanation.
Semester tokens may be used at any time during the active semester. Monthly tokens must be used during the applicable active month.
Requesting a Make-Up
A Make-Up Token Request Form must be submitted to request a make-up.
Clients should submit their request at least 24 hours in advance, or as far in advance as reasonably possible.
Requests submitted with less than 24 hours' notice may be considered at SJ Swim Master's discretion and are not guaranteed.
Make-up sessions are subject to availability and are not guaranteed for a specific date or time.
Token Rules
Make-up tokens:

Belong to the individual swimmer's Instructional Seat.
-
Cannot be sold, transferred, shared, or used by another swimmer, including siblings or family members.
-
Cannot be exchanged for refunds, credits, or cash.
-
Do not roll over to another enrollment period.
-
Expire at the end of the applicable semester or month.
Once a make-up session is scheduled using a token, the token is considered used. If the scheduled make-up is missed, an additional make-up token will not be provided.
6. Sibling Policy
Each child requires their own Instructional Seat.
At SJ Swim Master's discretion, siblings may be scheduled within the same instructional session when:

They are located in the same residential building.
-
Their skill levels are compatible.
-
The arrangement is safe and appropriate for instruction.
-
The instructor determines that shared instruction is appropriate.
Sibling scheduling is a courtesy accommodation and is not guaranteed.
Make-up tokens remain assigned individually to each swimmer and cannot be combined or transferred between siblings.
7. Instructor Assignment
Instructor consistency is prioritized whenever reasonably possible.
However, instructor assignments may vary based on:

Scheduling logistics
-
Route optimization
-
Instructor availability
-
Operational requirements
-
Illness or emergencies
Instructor changes do not constitute grounds for cancellation, refunds, or tuition adjustments.
8. Cancellations by SJ Swim Master
If SJ Swim Master cancels an instructional session due to instructor availability, facility constraints, severe weather, safety concerns, or other operational reasons, reasonable efforts will be made to provide an alternative solution or reschedule the session when feasible.
SJ Swim Master is not responsible for cancellations or closures caused by residential building management, pool maintenance, lifeguard requirements, facility restrictions, or circumstances outside of its control.
Any rescheduling resulting from a SJ Swim Master cancellation is handled separately from the client's make-up token allowance.
9. Enrollment Changes
Semester Enrollment cannot be paused once the semester begins.
Schedule changes may be requested but are subject to availability and are not guaranteed.
Monthly Enrollment remains subject to ongoing availability and may be discontinued when instructional capacity is allocated to Semester Enrollment.
10. Payment Terms
Semester Enrollment

Payment is required to reserve an Instructional Seat unless an approved payment plan has been established.

Payment secures placement within the selected semester cycle.
-
Seats are confirmed only upon receipt of the required payment.
Monthly Enrollment
-
Tuition is billed on a recurring monthly basis.
-
Continued enrollment is subject to timely payment.
-
Enrollment remains subject to instructional availability.
SJ Swim Master reserves the right to suspend instruction for overdue accounts.
11. Refund Policy
Enrollment reserves instructor time, scheduling capacity, and route placement.
Accordingly:
-
Tuition is generally non-refundable once the enrollment period begins.
-
Missed sessions do not qualify for refunds, credits, or prorated tuition.
-
Make-up tokens have no cash, refund, or credit value.
-
Unused make-up tokens do not result in a refund or credit.
-
Refunds, if any, are issued only when required by applicable law or at SJ Swim Master's discretion.
12. Capacity & Availability
Each building route has a limited number of Instructional Seats.
Once capacity is reached:
-
Enrollment closes for that route or enrollment period.
-
Additional applicants may be placed on a waitlist.
-
Enrollment may reopen in a future enrollment cycle as availability allows.
Placement from a waitlist is not guaranteed.
13. Building Access
All instruction takes place inside residential building pools provided by the client's property or an approved facility.
SJ Swim Master does not own, operate, or manage these pool facilities and is not responsible for facility operations, maintenance, staffing, closures, or building policies.
If a building is not currently part of an active route, families may join an interest list for future availability.
14. Agreement
By enrolling in SJ Swim Master, you acknowledge and agree to:

These Program Terms & Conditions should be read together with the applicable Enrollment Agreement, Program Policies, Cancellation Policy, and Liability Waiver.
